Terms of Service & Platform Conditions

Governing the use of Fotographiya Multi-Tenant Studio CRM and the Fotolancer Creator Marketplace

Last Updated: October 2026

Important Notice: By creating an account, accessing the Fotographiya Studio CRM, booking shoots, or joining the Fotolancer Creator Roster, you agree to be legally bound by these Terms of Service. If you do not agree, please discontinue using the platform immediately.

1. Parties, Acceptance & Definitions

1.1 This Agreement is entered into between Fotographiya Ventures Pvt. Ltd.(“Company,” “we,” “us,” or “our”) and the person or organization registering for or using our services (“User,” “Client,” “Studio,” or “Fotolancer”).

1.2 “Studio” refers to wedding photography companies and creative enterprises utilizing Fotographiya CRM for lead ingestion, quotation generation, gallery hosting, and crew dispatch.

1.3 “Fotolancer / Creator” refers to independent photographers, cinematographers, drone pilots, video editors, and digital artists registered on the platform to receive shoot dispatches and post-production contracts.

1.4 “Client” refers to couples, families, or corporate organizers whose event shoots are managed via the platform.

2. Platform Architecture & Independent Contractor Status

2.1 Zero Commission Model: Fotographiya does not deduct any percentage commission from creator shoot earnings. Fotolancers retain 100% of their negotiated daily or project rate.

2.2 Independent Status: Fotolancers are independent contractors and not employees, partners, or agents of the Company. Nothing in this Agreement creates an employment, agency, or franchise relationship.

2.3 Non-Exclusivity: Creators retain full freedom to accept direct clients, private assignments, and outside bookings. Using our Mission Calendar allows creators to declare open or blocked dates freely.

3. Studio Booking Rules & Milestone Escrows

3.1 Confirmed Dispatch: When a studio broadcasts a shoot beacon and a Fotolancer accepts the call sheet, a legally binding performance contract is formed between the Studio and the Fotolancer.

3.2 Milestone Security: To prevent payment fraud, studios must secure shoot booking advances into platform escrow before crew travel. Funds are released directly to creator UPI/bank accounts upon completion of shoot wrap and digital checksum media offload.

3.3 Payment Channels: All financial transactions on the platform are processed through RBI-authorized payment gateways (such as Razorpay / Cashfree) under 128-bit SSL encryption.

4. Equipment Standards & Media Offload Protocols

4.1 Hardware Standard: Camera crew members are required to operate dual-slot mirrorless/cinema bodies (e.g. Sony FX3/FX6/A7IV, Canon R5/R6) with fast optics and redundant battery packs as stated on their verified profile.

4.2 Same-Day Checksum Handoff: For on-location shoots, lead camera crew must hand over all uncompressed RAW media files and dual-recorded cards to the studio lead or designated DIT manager before leaving the event venue.

4.3 Emergency Replacement SLA: If a scheduled creator faces medical incapacity, the Fotolancer network immediately dispatches an emergency substitute of equivalent tier to avoid ritual coverage disruption.

5. Intellectual Property & Commercial Usage

5.1 Studio Deliverables:All raw media, final edited films, and high-resolution photo deliveries produced under a studio dispatch belong to the booking studio and the underlying client as per the studio's client contract.

5.2 Portfolio Showcasing: Fotolancers retain portfolio display rights to show selected curated clips and still frames on their personal portfolio, website, or Instagram after the primary client deliverables have been delivered by the studio, unless a strict Non-Disclosure Agreement (NDA) has been signed.

6. Limitation of Liability & Force Majeure

6.1 In no event shall the Company be liable for indirect, punitive, or consequential damages arising from bad weather, venue access denial, equipment failure, or third-party airline delays.

6.2 Neither party shall be held liable for failure to perform duties due to acts of God, civil riots, national curfews, or catastrophic weather events, provided timely communication is given through the portal.

7. Governing Law & Dispute Jurisdiction

7.1 This Agreement shall be construed in accordance with the laws of the Republic of India.

7.2 Any dispute, difference, or claim arising out of this Agreement shall be referred to sole arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Kota, Rajasthan, India.

7.3 The courts located in Kota, Rajasthan shall have exclusive territorial jurisdiction over any legal matters arising from this Agreement.
